ROUGE BORDEAUX IN FRANCE S.A.S.

This website contains our General Terms and Conditions in French. In the event of a dispute, the French version shall prevail.

 

ARTICLE 1 – COMPANY IDENTIFICATION

These terms and conditions apply to all services provided by ROUGE BORDEAUX IN FRANCE S.A.S., with a social capital of €7,850, registered under SIRET number 941 297 160 00017 (RCS Bordeaux). Registered office: 162 rue Anne de Tauzia, 33124 AUROS, France. Trademarks: "Rouge Bordeaux Tours", "Rouge Bordeaux B&B", "Maison d’hôtes Rouge Bordeaux".

 

ARTICLE 2 – ACCEPTANCE OF TERMS AND BOOKING VALIDATION

Important Notice: In accordance with Article 1113 of the French Civil Code, the partial payment (deposit/down payment) or full payment of an estimate or booking constitutes full and unreserved acceptance of these General Terms and Conditions. The contract is deemed read, signed, and approved upon receipt of the first payment (regardless of the 

amount) by ROUGE BORDEAUX IN FRANCE S.A.S.

 

ARTICLE 3 – DESCRIPTION OF SERVICES

The Company offers customized private travel services (Tours) and accommodation:

  1. Stays & Tours: Tailor-made itineraries, private transportation with driver, bilingual guide/translator, organization of visits (wineries, gastronomy, culture).

  2. Accommodation: Bed and Breakfast stays or selected seasonal rentals.

  3. Catering: Services of an independent private chef or restaurant reservations.

 

ARTICLE 4 – RATES AND PAYMENT TERMS

  • Prices: Prices are expressed in Euros (€) including all taxes (TTC/VAT).

  • Budget Overage: If the Client chooses a service (e.g., premium wine, optional activity) whose cost exceeds the budget allocated in the initial estimate, the difference must be paid immediately by the Client.

  • Payment: A 50% deposit is required upon booking. The remaining balance must be paid no later than 15 days before the start of the service. For any booking made within 15 days of departure, the full price is due immediately.

  • Fees: All bank fees and foreign exchange charges (for transfers outside the SEPA zone) are the sole responsibility of the Client.

 

ARTICLE 5 – CANCELLATION AND MODIFICATION

All cancellations must be notified in writing (email).

5.1. Cancellation by the Client (Policy):

  • More than 30 days before start date: 90% refund (10% administration fee retained).

  • Between 30 and 15 days: 50% refund.

  • Less than 15 days: No refund (100% of the price is retained).

  • Note: Penalties imposed by third-party providers (hotels, private chefs, external transporters) will be added to the Company's fees.

5.2. Cancellation by the Company:

The Company reserves the right to cancel a service in cases of force majeure, dangerous weather, or compromised safety. In such cases, all sums paid will be fully refunded, without further compensation.

 

ARTICLE 6 – LIABILITY AND SAFETY

  • Behavior: The Company reserves the right to interrupt the service without refund if a participant is in a clear state of intoxication, under the influence of narcotics, or displays violent/insulting behavior endangering the driver or others.

  • Alcohol: Alcohol consumption is the sole responsibility of the Client. Alcohol abuse is dangerous for your health.

  • Transportation: The driver-guide is bound by strict compliance with the French Highway Code. The Client cannot demand any speeding or dangerous maneuvers.

 

ARTICLE 7 – PARKING AND PROPERTY DAMAGE

  • Parking: Two parking spaces are available in front of the establishment (street side). Parking is free and unsupervised. The Company disclaims any liability for theft or damage to the vehicle.

  • Damages: The Client is responsible for any damage caused by their vehicle or themselves to the property’s infrastructure (walls, facade, gate, garden). Repair costs will be invoiced to the Client.

 

ARTICLE 8 – EQUIPMENT (BICYCLES)

In the event of bicycle rental, the Client is responsible for the equipment upon receipt. Any theft or damage will be invoiced. Wearing a helmet is strongly recommended; the Company disclaims all liability in the event of an accident without a helmet.

 

ARTICLE 9 – IMAGE RIGHTS

The Client authorizes the Company to take photographs during the stay and use them for promotional purposes (website, social media) for a period of 2 years, free of charge. The Client may oppose this use by simple written request.

 

ARTICLE 10 – DATA PROTECTION (GDPR)

Collected data is necessary for managing reservations. The Client has a right to access and rectify their data by emailing: rougebordeauxinfrance@gmail.com.

 

ARTICLE 11 – DISPUTES AND MEDIATION

These conditions are governed by French law. In the event of a dispute, the Client may have free recourse to a consumer mediator (AME CONSO). Failing an amicable agreement, the courts of Bordeaux shall have exclusive jurisdiction.

Ce document contient nos Conditions Générales de Vente en trois langues : Français, Anglais et Espagnol. En cas de litige, la version française fait foi.

 

ARTICLE 1 – DÉSIGNATION DU PRESTATAIRE

Les présentes conditions s'appliquent aux services fournis par la SAS ROUGE BORDEAUX IN FRANCE, capital social de 7 850 €, SIRET 941 297 160 00017 (R.C.S. Bordeaux), dont le siège social est situé au 162 rue Anne de Tauzia, 33124 AUROS, France. Marques exploitées : « Rouge Bordeaux Tours », « Rouge Bordeaux B&B », « Maison d’hôtes Rouge Bordeaux ».

 

ARTICLE 2 – ACCEPTATION DES CONDITIONS ET VALIDATION DE LA COMMANDE

Mention Importante : Conformément à l'article 1113 du Code civil, le règlement partiel (acompte/arrhes) ou total d'un devis ou d'une réservation vaut acceptation pleine et entière des présentes Conditions Générales de Vente. Le contrat est considéré comme lu, signé et approuvé dès la réception du premier paiement (quel qu'en soit le montant) par la SAS ROUGE BORDEAUX IN FRANCE.

 

ARTICLE 3 – DESCRIPTION DES SERVICES

La Société propose des prestations de séjours privés personnalisés (Tours) et d'hébergement :

  1. Séjours & Tours : Établissement d'itinéraires sur mesure, transport privatif avec chauffeur, guide-interprète, organisation de visites (domaines viticoles, gastronomie, culture).

  2. Hébergement : Nuitées en chambre d'hôtes ou locations saisonnières sélectionnées.

  3. Restauration : Mise à disposition d'un chef privé indépendant ou réservation de tables.

 

ARTICLE 4 – TARIFS ET MODALITÉS DE PAIEMENT

  • Prix : Les prix sont exprimés en Euros (€) TTC.

  • Dépassement de forfait : Si le Client choisit une prestation (ex: vin de prestige, activité optionnelle) dont le coût dépasse le budget alloué dans le devis initial, le surplus devra être réglé immédiatement par le Client.

  • Paiement : Un acompte de 50 % est exigé à la signature du devis. Le solde doit être réglé au plus tard 15 jours avant le début de la prestation. Pour toute réservation effectuée à moins de 15 jours du départ, la totalité du prix est due immédiatement.

  • Frais : Les frais bancaires et de change (hors zone SEPA) sont à la charge exclusive du Client.

 

ARTICLE 5 – ANNULATION ET MODIFICATION

Toute annulation doit être notifiée par écrit (email).

5.1. Annulation par le Client (Barème) :

  • Plus de 30 jours avant le début : Remboursement de 90 % (10 % de frais de dossier conservés).

  • Entre 30 et 15 jours : Remboursement de 50 %.

  • Moins de 15 jours : Aucun remboursement (100 % de la somme est due).

  • Note : Les pénalités imposées par des prestataires tiers (hôtels, chefs privés, transporteurs) s'ajoutent aux frais de la Société.

5.2. Annulation par la Société :

La Société se réserve le droit d'annuler une prestation en cas de force majeure, météo dangereuse ou sécurité compromise. Dans ce cas, l'intégralité des sommes versées sera remboursée, sans indemnité supplémentaire.

 

ARTICLE 6 – RESPONSABILITÉS ET SÉCURITÉ

  • Comportement : La Société se réserve le droit d'interrompre le service sans remboursement si un participant est en état d'ébriété manifeste, sous l'emprise de stupéfiants, ou adopte un comportement violent/insultant mettant en danger le chauffeur ou autrui.

  • Alcool : La consommation d'alcool s'effectue sous la seule responsabilité du Client. L'abus d'alcool est dangereux pour la santé.

  • Transports : Le chauffeur-guide est tenu au respect strict du Code de la Route. Le Client ne peut exiger aucun dépassement de vitesse ou manœuvre dangereuse.

 

ARTICLE 7 – PARKING ET DOMMAGES À LA PROPRIÉTÉ

  • Parking : Deux places sont disponibles devant l'établissement (côté rue). Le stationnement est gratuit et non surveillé. La Société décline toute responsabilité en cas de vol ou dégradation du véhicule.

  • Dommages : Le Client est responsable de tout dommage causé par son véhicule ou par lui-même aux infrastructures de la propriété (murs, façade, portail, jardin). Les frais de remise en état seront facturés au Client.

 

ARTICLE 8 – ÉQUIPEMENTS (VÉLOS)

En cas de location de vélos, le Client est responsable du matériel dès sa réception. Tout vol ou dégradation sera facturé. Le port du casque est vivement recommandé ; la Société décline toute responsabilité en cas d'accident sans casque.

 

ARTICLE 9 – DROIT À L’IMAGE

Le Client autorise la Société à prendre des photos pendant le séjour et à les utiliser à des fins promotionnelles (site web, réseaux sociaux) pour une durée de 2 ans, à titre gratuit. Le Client peut s'opposer à cette utilisation par simple demande écrite.

 

ARTICLE 10 – PROTECTION DES DONNÉES (RGPD)

Les données collectées sont nécessaires à la gestion des réservations. Le Client dispose d'un droit d'accès et de rectification par email à : rougebordeauxinfrance@gmail.com.

 

ARTICLE 11 – LITIGES ET MÉDIATION

Les présentes conditions sont régies par le droit français. En cas de litige, le Client peut recourir gratuitement à un médiateur de la consommation (AME CONSO). À défaut d'accord amiable, les tribunaux de Bordeaux seront seuls compétents.
