ARTICLE 1 - PURPOSE AND PREVALENCE
These conditions govern the guest room (B&B) services and the provision of common areas by SAS ROUGE BORDEAUX IN FRANCE. For direct bookings (website, email, phone), these GTC shall apply exclusively.
ARTICLE 2 - RESERVATION AND DEPOSIT (ACOMPTE)
2.1 Validation: A booking becomes firm upon written confirmation from the establishment and the receipt of a 50% deposit (acompte) of the total stay amount.
2.2 Balance: The balance of the stay and the tourist tax (€1.05/adult/night) must be paid at least one month prior to the arrival date.
2.3 Payment Methods: Cash, bank transfer, credit card, French check, or holiday vouchers (ANCV).
2.4 Duration: The contract is for a fixed term. The client has no right to remain on the premises after the stay ends.
ARTICLE 3 - CANCELLATION POLICY BY THE CLIENT
Per Art. L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation services.
Formalism: All cancellations must be notified in writing via email to: rougebordeauxinfrance@gmail.com. The date the email is received shall serve as proof of the cancellation date.
Cancellation Fees:

Cancellation more than 30 days before arrival: The 50% deposit paid at the time of booking is retained by the SAS.

Cancellation less than 30 days before arrival: The full amount of the stay is due to the SAS.

Last-minute booking: For any booking made within one month of arrival, the total amount is due immediately and is non-refundable in case of cancellation.

Shortened stay: No refund will be granted for early departures.
ARTICLE 4 - RATES AND TOURIST TAX
Prices include VAT (10% - para-hotel regime). The tourist tax is due per adult, per night, according to the legal rate in effect on January 1st.
ARTICLE 5 - ARRIVAL AND DEPARTURE (WEDDING SPECIFICITY)
5.1 Check-in: From 4:00 PM to 8:00 PM.
5.2 Key Collection: Guests must collect their keys before leaving for the ceremony or evening event. No key collection service will be provided during the night or upon return from the party. One key is provided per room.
5.3 Lost Keys: In the event of loss, a flat fee of €20.00 (tax incl.) per lost key will be charged to the client.
5.4 Check-out: Before 11:00 AM. Unauthorized late check-outs will be billed at 50% of the nightly rate.
ARTICLE 6 - CAPACITY AND EXTERNAL ACCESS
6.1 Capacity: Limited to 5 rooms and a maximum of 15 people.
6.2 Exclusivity: Only the registered resident guests identified in the contract are allowed on the property. Access to facilities (swimming pool, garden, kitchen, lounges) is strictly forbidden to any outside person (non-resident wedding guests, vendors, etc.).
6.3 PENALTIES: The presence of any unauthorized person on the property will result in a flat fee of €150 per person, per day.
6.4 Liability and Solidarity: When the contract is signed by a third party (e.g., the couple) for the benefit of final occupants (e.g., guests), the signee (referred to as "the Contractor") remains solely and solidarily liable for all obligations under these GTC. The Contractor guarantees that every occupant will strictly follow safety rules, capacity limits, night quiet hours, and the prohibition of outside guests. Any breach or damage caused by an occupant will be directly attributable to the Contractor.
ARTICLE 7 - HOUSE RULES AND SAFETY
7.1 Quiet Hours: Silence is required outdoors from 10:00 PM to 8:00 AM. The establishment is strictly non-smoking indoors.
7.2 Swimming Pool: Access is reserved for resident guests only. Children are the sole responsibility of their parents.
7.3 Kitchen and Refreshments: The kitchen is accessible. No full breakfast is served for weddings. The SAS only provides self-service coffee and tea until 10:00 AM at the latest.
7.4 Cleanliness: The kitchen must be left clean (dishes washed and put away). Extra cleaning fees (€50 to €90) will be charged in case of unsatisfactory condition.
ARTICLE 8 - PARKING
Two parking spaces are available in front of the house. The SAS disclaims all liability for theft or damage. Any damage caused by a vehicle to the property's infrastructure will be billed.
ARTICLE 9 - INTELLECTUAL PROPERTY AND REPUTATION
9.1 Commercial use of the establishment's image is prohibited. Any disparagement or malicious content posted online will lead to legal action (Art. 1240 of the French Civil Code).
9.2 Per the "Informatique et Libertés" law, your data is used solely for stay management. You have the right to access and rectify your data with management.
ARTICLE 10 - SECURITY DEPOSIT (CAUTION)
A security deposit of €1,000.00 is required upon key collection. This deposit guarantees the performance of obligations by the Contractor and all occupants. It may be withheld in part or in full for:

Any damage found in rooms or common areas.

Violation of the smoking ban (€150 flat fee for deodorization).

Application of penalties for unauthorized persons (€150/person).

Replacement of lost keys (€20/unit).

Exceptional cleaning fees (kitchen left dirty).
The Contractor expressly agrees that their liability may exceed the deposit amount if damages exceed €1,000.
ARTICLE 11 - DISPUTES AND MEDIATION
In the absence of an amicable settlement, the client may contact a mediator free of charge. French law applies, and the courts of Bordeaux shall have sole jurisdiction.
Claims must be submitted within 7 days.
CONSUMER MEDIATION
Per Art. L.612-1 to L.612-5 of the French Consumer Code, any consumer has the right to use a consumer mediator for the amicable resolution of a dispute with a professional.

ARTICLE 12 - SIMPLIFIED SANITARY CONTROL PLAN (SCP)
I. Personal Hygiene: Mandatory hand washing; clean attire.
II. Temperature Control: Daily fridge check (0°C to +4°C).
III. Storage: Expiration date checks; separation of raw and cooked goods.
IV. Cleaning: Countertops and utensils cleaned after each use.
V. Allergen Management: Inquiry at booking; mandatory display.
